Definitions

Agreement – these Terms and Conditions;

Company – Gastronome Georgia LLC (ID 418473547), which is the owner and organizer of the loyalty program;

Loyalty Program (Program) – an incentive system developed by the Company that allows the customer to benefit from special discounts based on their purchase history;

Customer – any natural person who registers in the Program, agrees to the rules, and holds an active loyalty card;

Registration – the customer filling in the mandatory personal data required in the application in order to accumulate points;

Personal data – the customer's personal data requested at registration – first name, last name, date of birth, personal ID number, and mobile number;

Active account – the customer's account on which points are accumulated;

Barcode – a unique code shown on the digital card, used to accumulate points and receive the corresponding discount (and to identify the customer or merchant);

Average spend of the last 3 months – the total value of purchases made in a given period (the 3 full calendar months preceding the current month) divided by four. This figure determines the discount percentage.

Status – the customer's level in the Program (3%, 5%, 7%, or 10%), which is reviewed at the end of each month and depends on the average spend of the last 3 (three) calendar months.

SMS-OFF – a simplified mechanism (a link or special code) for opting out of marketing messages;

PUSH notification – a message sent to the mobile phone by the digital card;

Transaction – any paid operation (purchase) made in the Gastronome gourmet store network that is recorded using the loyalty card;

Account suspension – a temporary restriction of access to the account;

Account cancellation – full deactivation of the account and exclusion from the Program;

General Provisions

This document defines the terms and conditions of participation in the loyalty program of the Gastronome facility of Gastronome Georgia LLC (ID 418473547) (hereinafter the "Company").

By registering the digital card and pressing the "I Agree" button, the customer expresses consent to the terms and conditions set out below and confirms that they have fully read the Program's policy.

The Loyalty Program (hereinafter the "Program") is a product created by Gastronome Georgia LLC, aimed at rewarding loyal customers.

Within the Program, purchases made in the Gastronome gourmet store network are recorded on the customer's personal account, on the basis of which they are assigned a corresponding status and discount.

Joining the Loyalty Program

Any natural person who is at least 18 years old may participate in the Program.

Registration is done by scanning a QR code, or by going directly to the application link and entering personal data.

The loyalty card is personal and may not be transferred to another person.

Description of the Loyalty Program

The Loyalty Program is a system created by the Company that allows the customer to receive a corresponding discount based on the average spend of the last 3 months. The discount system is progressive and is defined by the following levels: 3%, 5%, 7%, and 10%.

The discount percentage depends on the volume of the customer's average spend over the last 3 months in the store:

Bronze: ₾50 – ₾149 — 3% discount

Silver: ₾150 – ₾249 — 5% discount

Gold: ₾250 – ₾399 — 7% discount

Platinum: ₾400+ — 10% discount

Status recalculation: the discount percentage is recalculated at the end of each month, based on the previous 3 months' data. The customer is sent a Push notification about the updated status, unless they have disabled notifications in the application settings.

Status upgrade: if the average spend of the last 3 months exceeds the threshold of the next level, the customer is assigned a higher status, according to the figures defined in clause 4.2.

Status maintenance: if the customer's activity decreases and the average of the last 3 months falls below the corresponding threshold, their discount percentage is automatically adjusted (reduced) according to the figure defined in clause 4.2.

New customer status: a customer registering in the Program for the first time is automatically granted a 3% discount as a gift immediately upon registration, valid for 1 calendar month. From the following month, their status is recalculated in accordance with the general rule defined in clause 4.2.

Existing customer status: existing loyalty card holders, when migrating to the new system, are assigned their initial discount percentage based on their spending history over the last 3 (three) months, according to the figures defined in clause 4.2.

Status visualization: the display of the current discount % is an integral part of the digital loyalty card design added to the Wallet, allowing the customer to verify their status at any time.

Spending points accumulated in the old system: in connection with the migration to the new model, customers are given a 3 (three) month period to use up the balance of points accumulated under the old system. This period is counted from the date the Company sends the informational SMS and email notifications.

Cancellation of points: upon expiry of the 3 (three) month period specified in clause 4.9 of this document, any unused balance (accumulated points/GEL) on the old cards is fully cancelled. These points will not be restored or transferred to the new application.

Card activation: 1 (one) business day is required from card registration (installation on the smartphone) to its full activation. The customer will be able to use the discount on the business day following registration.

Company's Rights

The Company is entitled to:

Suspend or cancel a customer's account if abuse of the loyalty program is detected, such as the provision of incorrect or false information, transfer of the account to a third party, breach of technical systems, or any other action that violates these rules or applicable law;

At any time, without prior notice, change or update the monetary limits and/or other conditions defined for a status. The updated conditions are automatically reflected both in the card's "Info" section and on the relevant web page, and take effect upon publication.

Temporarily suspend the operation of the Program for technical reasons.

Processing of Personal Data (Privacy Policy)

By registering in the application, the customer expresses their will and gives the Company unconditional consent to process their personal data in accordance with the Law of Georgia "On Personal Data Protection".

The processed data includes: first name, last name, personal ID number, phone number, date of birth, and transaction history (purchased products, amount spent, time and place of visit).

Purposes of data processing:

Administering the loyalty program and calculating discounts;

Improving service quality and analyzing customer behavior;

Informing the customer about individually tailored offers and news;

The Company undertakes to protect data security and not to transfer it to third parties, except in cases provided by law or to technical partners that ensure the proper operation of the application (with a guarantee of confidentiality).

The customer has the right at any time to request information about the processing of their data, and to request its correction, update, or deletion. A deletion request can be made by sending a message to the email specified in the Company's contact details. Deletion of data results in cancellation of the loyalty account.

Data is stored during the period of participation in the Program and for 1 (one) year after its termination, in accordance with the law.

Marketing Communication and Opt-out

By registering for this agreement, you agree to receive notifications about news, promotions, and status via the application (Push) and SMS.

Push notifications: you can disable them at any time from your mobile phone's notification settings.

SMS notifications: each marketing SMS includes an opt-out (SMS-OFF) link, through which you can immediately stop receiving messages.

Terms of Use of the Application

The digital card can be activated on iOS and Android platforms;

On the back of the digital card (by opening the "Info" section), the customer can review the conditions of the statuses and other benefits. A direct link to the personal data processing policy and to these Terms and Conditions is also placed there.

The customer is obliged to protect the security and confidentiality of their account, and to immediately notify the Company if there is any suspicion of unauthorized use of their account.

The Company is not responsible for damage resulting from the customer's violation of security rules (e.g., use of the discount by a third party).

The Company is not responsible for damage caused by technical disruptions; however, it ensures that faults are remedied within a reasonable time.

The Company is not responsible for:

the actions of third parties;

improper use of the account by the customer;

disruptions caused by technical faults.

delays in status updates caused by technical faults.

Additional Restrictions

The discount card may only be used by the authorized customer;

The discount does not apply to:

products already on promotion;

the purchase of gift cards;

The Company is entitled to define additional restrictions on specific products.

The Company reserves the right, in case of suspicion of abuse of the Program (e.g., the use of one card by many different persons), to temporarily or permanently block the customer's loyalty card.

Final Provisions

These terms take effect from the moment of the customer's registration.

Any dispute that may arise between the parties shall be resolved through negotiation, and in the event that no agreement is reached – in accordance with the applicable legislation of Georgia.

The Company reserves the right to change the discount percentages or the principle of status assignment, in accordance with clause 5.1.2.
